Terms of Use
Last updated: September 2026
These terms govern use of freshout360.com and the FreshOut 360 platform, operated by FreshOut Education. By creating an account or using the platform, you agree to these terms. Organizations with a signed service agreement are governed by that agreement where it differs from these terms.
The service
FreshOut 360 is an operations platform for nonprofit organizations, including case management, intake forms, trainings, reporting, referrals, and grant tracking. We may improve or change features over time, and we will not materially reduce the core functionality your organization pays for during a subscription term.
Accounts
Your organization is responsible for the accuracy of its account information, for maintaining the confidentiality of user credentials, and for the actions taken under its accounts. Each login is for one named person; sharing logins undermines the audit trail that protects your clients. Tell us promptly at 360@freshouteducation.org if you suspect unauthorized access.
Acceptable use
You agree not to misuse the platform, including attempting to access another organization's data, probing or disrupting our systems, uploading malicious code, or using the platform to violate the law or the rights of others.
Your data
Your organization owns the data it enters. You grant us the limited rights needed to host, process, back up, and display that data in order to provide the service. Our Privacy Policy and Data Security pages describe how we protect it. You are responsible for having the authority and any consents needed to enter the information you record about the people you serve.
Fees
Subscription fees, billing periods, and payment terms are set out in your organization's order or service agreement. There are no setup fees and no hidden costs.
Availability and disclaimers
We work to keep the platform available and reliable, but no software service can promise uninterrupted operation. The platform is provided "as is" to the maximum extent permitted by law. Nothing in the platform is legal, medical, or clinical advice.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our total liability arising out of the service is limited to the fees your organization paid in the twelve months before the claim.
Termination
Your organization may stop using the service as set out in its agreement. We may suspend or end access for material violation of these terms after notice and a reasonable chance to fix the issue. After termination we return your data and then delete it, as described on the Data Security page.
Changes and contact
We may update these terms; material changes will be posted here with a new effective date and notice to account administrators. These terms are governed by the laws of the State of California. Questions: 360@freshouteducation.org.
